General Terms and Conditions (GTC) of Bodewig Dressage GbR

1. Scope

These General Terms and Conditions (GTC) apply to all contracts for the riding, training and care of horses between Bodewig Dressage GbR (hereinafter "Bodewig Dressage") and its customers, unless otherwise agreed in writing.

2. Subject of the contract The subject of the contract is the training and care of horses in accordance with the individual agreements in the riding contract. The exact services provided within the framework of the contract are specified in the respective riding contract.

3. Contract duration and termination

3.1.The contract is concluded for an indefinite period and can be terminated by either party in writing with four weeks’ notice to the end of the month.

3.2.Extraordinary termination for good cause remains unaffected.

3.3.In case of early collection of the horse, the customer remains obliged to pay the full fee for the agreed period.

4. Prices and payment terms

4.1.The prices for riding lessons and additional services are specified in the respective riding contract.

4.2. Payment is made monthly in advance after invoicing. All additional costs, such as veterinary, physiotherapy and farrier costs, will be invoiced to the customer separately.

5. Services and Liability

1. Bodewig Dressage undertakes to train and care for the horse according to the principles of classical riding. A specific result is not guaranteed.

2. Bodewig Dressage is only liable for damages caused by intentional or grossly negligent conduct of its employees.

3. The customer is obliged to take out liability insurance for his horse and to provide proof of this upon request.

6. Health status and veterinary care

1. The customer assures that the horse is free from contagious diseases and has been regularly vaccinated and dewormed.

2. If necessary, Bodewig Dressage is entitled to arrange veterinary measures if the customer or a designated person of trust cannot be reached. The costs are borne by the customer.

7. Additional provisions for vacation and downtime and compensation

1. Holiday times of the riders

1.1.The riders are entitled to up to 4 weeks holiday per year without this leading to a reduction in the agreed remuneration. The exact holiday periods will be communicated to the owner at least four weeks in advance.

1.2.During the riders' vacation periods, the horse is trained and cared for by a qualified and experienced representative. This representative is carefully selected by the riders and instructed in the horse's special needs.

1.3.If, in exceptional circumstances, no suitable substitute is available and the riders take more than the agreed 4 weeks' holiday, the owner can decide whether to suspend the riding during this additional time. In this case, the remuneration will only be reduced proportionately for the holiday periods exceeding the 4 weeks.

2. Illness or other absence of the riders

1. In the event of absence due to illness or other unforeseeable downtime of the rider, the owner will be informed immediately.

2. The riders are entitled to appoint a qualified representative to train and care for the horse. If no suitable representative is available, the training will be suspended for the duration of the absence and the remuneration will only be reduced proportionately for the period exceeding 4 weeks.

3. If the outage lasts longer than two weeks beyond the holiday period, both the owner and the riders have the right to terminate the contract with two weeks' notice to the end of the month.

3. Downtime of the horse or the owner

1. If the horse or the owner is unavailable for up to 2 weeks (e.g. due to illness of the horse or injury of the owner), no refund of the fee already paid will be made. Instead, a discount of 15% will be granted on the subsequent invoice.

2. In case of a failure of more than 2 weeks but less than 4 weeks, a discount of 30% on the subsequent invoice will also be granted.

3. If the horse is absent for a period of 4 weeks or longer, the fee will be reduced proportionately from the 4th week onwards. The reduction will be reflected in the next invoice.

4. The remuneration for the current month remains the same regardless of the downtime. Refunds will only be made if the downtime lasts more than 4 weeks and cannot be compensated within the same contract month. 4. Representation in the absence of the riders In the event of Corinna and/or Robinson Bodewig's absence, our qualified employee Lea Schwarz will take over the care and exercise of the horse. She ensures that the training and care are continued at the usual quality in order to ensure the well-being of the horse at all times.

5. Optional lesson at Goldstern Training Customers of the Goldstern Training package have the option of taking an optional lesson with Corinna or Robinson Bodewig:

1. Additional unit: If an additional unit is required beyond the regular partial riding, the unit price is €70.00.

2. Replacement of a regular unit: If the customer wishes to replace a unit that would originally be carried out by our employee with a unit with Corinna or Robinson, an additional amount of €40.00 will be charged.

8. Use of images Bodewig Dressage is entitled to use images and video material of the horse for its own purposes, unless the customer expressly objects to this use.

9. Sales commission when selling the horse If a horse that has been demonstrably trained by BODEWIG DRESSAGE for at least 6 months is sold, a net commission of 10% of the sales price achieved is due to BODEWIG DRESSAGE. The commission is to be paid to BODEWIG DRESSAGE immediately after the sale is completed and is made after the invoice is issued. This regulation also applies if the horse is sold within a period of 6 months after collection by the customer or a third party, provided that the horse was previously in training or riding with BODEWIG DRESSAGE for at least 6 months.

10. Support and training by employee Lea Schwarz As part of the training at BODEWIG DRESSAGE, it can happen that our employee Lea Schwarz rides the horses at the beginning of the training and warms them up (work-down) or prepares them for the actual training session before Corinna or Robinson Bodewig take over the rest of the training. This procedure serves to optimally prepare the horse and ensures that it is as well prepared as possible for the subsequent training session. For customers who have booked the Goldstar training and have chosen the cheaper option, Lea Schwarz takes over the training of the horse independently under the supervision and instruction of BODEWIG DRESSAGE. All customers are informed that in such cases Lea Schwarz will carry out the training sessions accordingly. Lea Schwarz always acts within the framework of the training methods and specifications set by Corinna and Robinson Bodewig. The customers agree to this regulation and acknowledge that the training can also be carried out partially or completely by Lea Schwarz, provided this is provided for in the respective riding package.

11. Data protection The customer’s personal data will be used exclusively for contract processing and will not be passed on to third parties unless this is necessary for the execution of the contract.

12. Severability Clause Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by an effective provision that comes as close as possible to the economic purpose of the invalid provision.

13. Applicable law and place of jurisdiction The law of the Federal Republic of Germany applies. The place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of Bodewig Dressage GbR.
